  4. Oklahoma, sets a standard for the length of time that business

  6. retention for a longer period of time, the longer statute
  7. applies. In many instances corporations have made specific
  8. policies for record destruction. The "Pack rat" syndrome has come
  9. to haunt a few firms, when partial records from many years past

  12. Uniform Preservation of Private Business Records Act (1954)
  13.  
  14. Section 1. Definitions.
  15.  
  16. As used in this Act:
  17.  
  18. "Business" includes every kind of private business, profession,
  19. occupation, calling or operation of private institutions whether
  20. carried on for profit or not.
  21.  
  22. "Person" means an individual, partnership, corporation, or any
  23. other association.
  24.  
  25. "Records" or "Business Records" includes books of account,
  26. vouchers, documents, canceled checks, payrolls, correspondence
  27. record of sale, personnel, equipment and production, reports
  28. relation to any or all of such records and other business papers.
  29.  
  30. "Reproduction" means a reproduction or durable medium for making
  31. a reproduction obtained by photographic, photostatic, microfilm,
  32. microcard, miniature photographic or other process which
  33. accurately reproduces or forms a durable medium for so
  34. reproducing the original.

  36. Section 2. Period of Preservation.

  38. Unless a specific period is designated by law for their
  39. preservation, business records which persons by the laws of this
  40. state are required to keep or preserve may be destroyed after the
  41. expiration of three years of making such records without
  42. constituting an offense under such laws. This section does not
  43. apply to minute books of corporation nor to records of sales or
  44. other transaction involving weapons, poisons or other dangerous
  45. articles or substances capable of use in the commission of
  46. crimes.

  48. Section 3. Preservation of reproductions
  49.  
  50. if in the regular course of business a person makes reproductions
  51. of original business records, the preservation of such
  52. reproductions constitutes compliance with any laws of this State
  53. requiring that business records be kept or preserved.

  55. Section 4. Destruction of Records by State Officers
  56.  
  57. Nothing in this Act shall be construed to diminish the authority
  58. of an officer of this State under existing law to permit the
  59. destruction of business records.

  61. Section 5. Uniformity of Interpretation.
  62.  
  63. This Act shall be so interpreted and construed as to effectuate
  64. its general purpose to make uniform the laws of those states
  65. which enact it.
  66. Section 6. Short title.
  67.  
  68. This Act may be cited as the Uniform Preservation of Private 
  69. Business Records Act.
